How a mining claim works

Five steps stand between finding gold and legally holding the ground it sits in.

  1. Discover

    Find a valuable mineral deposit on open federal land that isn’t already claimed or withdrawn.

  2. Locate & stake

    Mark the claim boundaries on the ground and post a location notice, per your state’s rules.

  3. Record with the county

    File your location notice with the county recorder where the claim sits, within the state’s deadline.

  4. File with BLM

    Submit the claim paperwork and fees to the Bureau of Land Management to put it on federal record.

  5. Maintain annually

    Pay maintenance fees or file the small-miner waiver and assessment work each year — miss it and the claim is gone.
